SimplyBoost provides an AI-powered sales and support agent platform that enables businesses to automate customer engagement across website, WhatsApp, Instagram, Facebook Messenger, and other channels. Services include lead capture, conversation automation, meeting booking, and analytics.
3. Accounts and Access
You must create an account to use most features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old and have authority to enter into these Terms on behalf of any organisation you represent.
SimplyBoost reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform.
4. Acceptable Use
You agree not to use SimplyBoost to:
- Send unsolicited bulk communications, spam, or phishing messages.
- Violate any applicable laws, regulations, or third-party rights.
- Transmit harmful, offensive, or illegal content.
- Attempt to reverse engineer, copy, or resell the platform without authorisation.
- Interfere with or disrupt the integrity or performance of the services.
- Circumvent access controls or security measures.
5. Payments and Subscriptions
Paid plans are billed monthly or annually in advance. Prices are as displayed on our pricing page and are subject to change with reasonable notice. You may cancel at any time; no refunds are provided for unused portions of a billing period unless required by law.
All payments are processed securely. SimplyBoost does not store full payment card details on its servers.
6. Intellectual Property
SimplyBoost and its licensors own all rights, title, and interest in the platform, software, and content. You retain ownership of the content and data you provide. By using our services, you grant SimplyBoost a limited licence to process your content solely to provide the services.
7. Data and Privacy
Your use of SimplyBoost is also governed by our Privacy Policy and Cookie Policy. We process personal data in accordance with applicable data protection laws, including the GDPR where applicable.
8. Disclaimers and Limitation of Liability
The services are provided “as is” without warranties of any kind. SimplyBoost does not guarantee uninterrupted availability or that the platform will be error-free.
To the fullest extent permitted by law, SimplyBoost’s aggregate liability for any claims arising from these Terms or use of the services shall not exceed the fees paid by you in the twelve months preceding the claim.
9. Termination
Either party may terminate the agreement at any time. Upon termination, your access to the platform will cease. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.
10. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Utrecht, Netherlands, unless mandatory consumer protection laws in your jurisdiction require otherwise.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our platform. Continued use after the effective date constitutes acceptance of the updated Terms.
